Ohpolny Terms of Purchase

These Terms of Purchase govern your use of Ohpolny’s website (the “Site”) and any purchase of our London-designed womenswear (the “Products”) from us. By placing an order on the Site, you agree to be bound by these terms, as well as our Privacy Policy, Refund Policy, and Shipping Policy (all available on the Site). We recommend reviewing these terms carefully before making a purchase.

1. Order Placement & Confirmation

a. How to Place an Order

To purchase Products from Ohpolny, you must:

  • Be at least 18 years old (or have the consent of a parent/guardian if under 18).
  • Provide accurate, complete, and up-to-date information (e.g., shipping address, email, payment details) during checkout.
  • Select the desired Products, sizes, and quantities, then follow the on-screen prompts to complete payment.

b. Order Confirmation

  • Once you submit your order, you will receive an order acknowledgment email (sent to your provided email address) to confirm we have received your request. This is not a formal acceptance of your order.
  • We formally accept your order (and form a binding contract between you and Ohpolny) only after we:
  1. Verify the availability of the selected Products.
  2. Confirm the validity of your payment.
  3. Send a shipping confirmation email (including a tracking number) to notify you that your order has been dispatched.
  • If we cannot accept your order (e.g., Product out of stock, payment failure, incorrect information), we will notify you via email within 2 business days and issue a full refund (if payment was processed) within 5-10 business days.

2. Payment Terms

a. Currency & Pricing

  • All Product prices on the Site are displayed and charged in United States Dollars (USD), inclusive of applicable taxes (e.g., sales tax for US orders). Any additional customs duties or import taxes for international orders are the sole responsibility of the recipient (see Section 5 for details).
  • We reserve the right to update Product prices at any time, but changes will not affect orders that have already received a shipping confirmation.

b. Payment Methods

3. Shipping & Delivery

a. Order Processing Time

  • All in-stock Products are processed within 1-3 business days of order placement (excluding weekends and public holidays). For pre-order or custom Products, processing times will be clearly stated on the Product page.

b. Delivery Timeline & Shipping Costs

  • Global Delivery: We offer free shipping worldwide on all orders, with no minimum purchase required.
  • Delivery Timeline: After dispatch, Products will be delivered to your shipping address within 6-12 business days (estimated, based on your location and carrier performance). Remote regions may experience minor delays, but we will notify you of any significant hold-ups via email.

c. Delivery Responsibilities

  • You must provide a valid, accessible shipping address. We are not liable for delays or non-delivery caused by incorrect or incomplete address information.
  • Upon delivery, please inspect the package for damage. If the package is damaged, refuse delivery (if possible) and contact our customer service team at [email protected] within 48 hours of attempted delivery.
  • If a delivery is marked as “delivered” but you have not received the package, contact us within 7 days of the delivery confirmation—we will work with the carrier to locate the package or arrange a replacement/refund.

4. Returns & Refunds

a. Return Eligibility & Timeline

  • You may return any unused, undamaged Product (with original tags, packaging, and labels intact) for a refund within 60 days of delivery. Final sale Products (marked “Final Sale” on the Product page) are not eligible for returns.

b. Return Process

To initiate a return:

  2. We will send a pre-paid return shipping label (global coverage) and return instructions within 2 business days.
  3. Package the Product securely, attach the return label, and ship it back to us. We recommend using a trackable shipping service (we are not liable for lost return packages).

c. Refund Processing

  • Once we receive and inspect the returned Product (typically 3-5 business days after delivery to our warehouse), we will confirm eligibility and initiate a refund to your original payment method.
  • Refunds will be processed within 5-10 business days of inspection, with the full order amount (in USD) refunded (excluding any original shipping costs—though we offer free shipping, so no deductions apply).
  • Refund timelines may vary slightly based on your bank or payment provider (e.g., credit cards may take 3-7 additional days to reflect the refund).

5. Customs & Import Duties (International Orders)

  • For orders shipped outside the United States, you may be required to pay local customs duties, import taxes, or fees (determined by your country’s customs authority). These charges are your responsibility—Ohpolny does not collect them at checkout and has no control over their amount.
  • If you refuse to pay customs duties/taxes and the package is returned to us, you will be responsible for any return shipping costs incurred. We will then process a refund for the Product cost (in USD) minus these return fees.

6. Product Availability & Accuracy

  • We strive to maintain accurate stock levels and Product descriptions (e.g., size, color, fabric) on the Site. However, occasional errors may occur (e.g., stock discrepancies, typographical mistakes).
  • If a Product is unavailable after you place an order, we will notify you via email and issue a full refund within 5-10 business days.
  • Colors of Products may vary slightly from the Site images due to differences in device screens (e.g., smartphone, laptop) and lighting—we do our best to represent colors accurately, but this variation is not grounds for a return.

7. Cancellations

  • Once an order is dispatched, you cannot cancel it—you must follow the return process outlined in Section 4 if you wish to return the Product.

8. Limitation of Liability

  • Ohpolny is liable for any direct damage caused by our negligence (e.g., defective Products, failure to process a refund as promised). However, we are not liable for indirect, incidental, or consequential damages (e.g., loss of use, inconvenience, missed events) arising from your purchase or use of our Products.
  • Our total liability for any claim related to a purchase will not exceed the total amount you paid for the affected Product(s).
